There are two levels of membership within RunRideRun.com. – Training Member (‘TM’) and Competing Member (‘CM’). Becoming a TM is free and lets you everything on our site except enter or create events.

If you want to create or enter an event, you will need to become a CM which costs AUD$38.50 per annum (inc GST) and which gives you full insurance cover for the events you enter. For more information click here."

At RRR.com we are committed to best practice measures in all that we do. We aim to maintain a high level of customer support for our members as well as offering our members access to all relevant information regarding our website's terms and conditions and our commitment to respecting your privacy. 

It is important that all our members understand and agree to our terms and conditions and we encourage you to contact us should you require any clarification. Our contact details are listed at the start of this Agreement for your convenience. 

These are the current terms and conditions relating to the Agreement ( 'Agreement ') between you and RRR.com. 

By proceeding further, you agree that these terms and conditions form the Agreement between you and RRR.com and that you agree to be bound by these terms and conditions at all times. 

Please read them very carefully and if you do not agree with them, please do not register as a member or use this website located at the URL http://www.runriderun.com (the 'RRR.com website').  If you proceed to register as a member of RRR.com or continue to use the RRR.com website you will be deemed to have accepted these terms and conditions and you will agree to be bound by them.

Effect of acceptance
Please note that on completion of the RRR.com online registration process, which includes you expressly acknowledging that you have read, understood and accept these terms and conditions, your membership will be activated and you will have entered into a legally binding agreement with RRR.com for the provision of the RRR.com services available on or through this website (Service). You should read the following terms and conditions carefully before completing the registration process.

Amendment, termination and entire agreement 
These terms and conditions are subject to change by RRR.com at any time at our sole discretion. We will notify you by email if there are any material changes to these terms and conditions which we believe may directly impact on you.  If you subsequently continue to use the RRR.com website or continue as a member of RRR.com, you will be deemed to have accepted the terms and conditions as amended.

Please note that RRR.com reserves the right to terminate your membership for any reason, and reserves all of its rights in relation to all other matters. 

These terms and conditions form the entire agreement between you and RRR.com unless expressly stated by us otherwise and apply to the entire RRR.com website as well as to any correspondence, communication and other interaction of any kind between RRR.com, as the service provider, and you, as the member. 

A reference to the terms and conditions or Agreement means these terms and conditions (and the Agreement constituted by same) as amended from time to time.

Minimum age 
In order to become a member of RRR.com you must be at least 18 years old. RRR.com operates as a service strictly for people over the age of 18 years. Please do not attempt to register if you are under 18 years old. If you are under 18 years of age, or if RRR.com has prohibited, suspended or terminated your membership, then your membership of this Service is invalid. By completing online registration, you expressly represent and warrant that you are 18 years of age or older and you have the right, authority, and legal capacity to enter into this Agreement and to abide by all its terms and conditions. We reserve the right to check at our sole discretion at any time that you are a minimum of 18 years of age by any legal means available to us.

Zero tolerance anti doping policy
By becoming a member of RRR.com you expressly acknowledge RRR.com s philosophy of zero tolerance of illegal or illicit drug use of any kind or the use of any banned performance enhancing substance in line with the guidelines of the Australian Government s Sports Commission policy on anti-doping in sport. Further, you agree to be bound by and uphold the principles of the World Anti Doping Code, the details of which can be found at http://www.ausport.gov.au/ethics/adwadacode.asp. 

RRR.com reserves the right at all times to terminate your membership if we become aware of any infringement by you of our zero tolerance policy towards the use of illegal or illicit drugs or any infringement by you of the World Anti Doping Code. We also reserve the right to advise the Police or relevant legal authorities of any infringement of our stated policy in this regard where we have reasonable grounds of suspicion of a breach or the possible committing of a criminal offence. We do not need to notify you of this if we have reasonable grounds for suspicion that you are in breach of our zero tolerance policy as stated in this clause.

Acknowledgment of Risk, Informed Consent, Waiver and Indemnity 
You as the member hereby acknowledge that RRR.com makes no warranties of any kind, express or implied, and does not guarantee any individual physiological, psychological, performance or sporting results in relation to any event, promotion or service provided or promoted by RRR.com as part of the Service that you may undertake or engage in by virtue of your participation as a member of RRR.com.

You acknowledge further that you solely, and not RRR.com, is personally responsible for the achievement of any individual physiological, psychological, performance or sporting goals and that such goals are determined solely by you based on your own specific circumstances and having regard to your own independent physiological and medical advice from a professionally qualified and currently practicing medical practitioner which we strongly recommend you obtain before commencing any form of exercise based program.

You further acknowledge that you understand fully and expressly acknowledge that athletic training is inherently dangerous and carries with it the potential for death, serious injury and property loss. You understand and agree that you assume totally the risk of participating in any Service promoted or marketed by RRR.com or any of its servants, agents or partner merchants from time to time.

You further acknowledge, represent and warrant to RRR.com and any of our partner merchants from time to time that you have not been advised against participation by any qualified health professional, and that in consideration of this Agreement you hereby indemnify, release and forever discharge and hold harmless RRR.com or any of its servants, agents or partner merchants from time to time from any liability, claims, losses, costs, or expenses. 

You further acknowledge, represent and warrant to RRR.com and any of our partner merchants from time to time that you forever waive the right to pursue legal action against RRR.com or any of its servants, agents or partner merchants from time to time arising directly or indirectly from your participation in the Services, including claims or damages resulting from death, personal injury, partial or permanent disability, property damage, medical or economic loss.

You further acknowledge that this Agreement will be binding on your legal heirs, assignees, successors and personal representatives.

You further acknowledge that you do not currently suffer from any physical or mental condition that would impair your ability to fully understand the terms and conditions of this Agreement and to meet your obligations therein.

You further acknowledge and agree that RRR.com expressly disclaims any warranties with respect to any products or promotional materials offered by any third parties or partner merchants and provided, offered or made available to you by RRR.com, including (but not limited to) the implied warranties of merchantability, fitness for a particular purpose and non   infringement of any rights of any other person. 

Events
Relationship:  We are not a provider of gym facilities, gym equipment, gym membership or gym services.  You understand and acknowledge that use of a gym is subject to separate arrangements, agreements and terms and conditions entered into between you and your gym that we are not party to, privy to or in any way involved in.  You accordingly release and indemnify us from any and all claims, demands and proceedings that may arise out of your arrangement or agreement with your gym and hereby release and indemnify us against all liability for all injury, loss or damage arising out of or connected with your use of gym facilities, equipment, services or membership. 

Physical condition:  You warrant and represent on the date of becoming a member of RRR.com, and repeat such warranty and representation each time you use gym facilities for the purposes of training for the Services the subject of this Agreement between you and RRR.com, that you are in good physical condition and that you know of no medical or other reason why you are not capable of engaging in active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort or physical condition.  

Use of equipment:  You acknowledge that it is your sole responsibility to ensure that you correctly operate or use any exercise equipment used in connection with the Services the subject of this Agreement, including the adjustment of levels or settings on the equipment.  If you are in doubt as to how to correctly operate any exercise equipment you should consult a staff member of the gym premises at which you are using the equipment prior to use.

Competing in events:  You acknowledge that competitive events involve the real risk of serious injury or even death from various causes including, without limitation, overexertion and dehydration.  

You understand that you should not compete in an event unless you have trained appropriately for the event and your physical condition has been verified by a medical practitioner.

You warrant that you have informed RRR.com, host gymnasium or event organiser of your medical or physical conditions from which you suffer that might affect your performance or be relevant if medical treatment is needed.  You accept the risk of competing despite these conditions.

By competing, you accept all risks that flow from your participation which could result in injury or death.  You accordingly release all persons or corporations directly or indirectly associated with the conduct of the event from all claims, demands and proceedings arising out of your participation and hereby release and indemnify them against all liability for all injury, loss or damage arising out of or connected with your participation in an event.  This release and indemnity shall extend to and include RRR.com, the event organiser and their respective directors, partners, managers, officers, agents, contractors, employees and volunteers including medical and paramedical personnel appointed for an event, the owners, licensees and occupiers of premises or land upon which an event or any part of an event is conducted, any statutory body or local authority having control over any land upon which an event is conducted or which is involved directly or indirectly with an event in any manner whatsoever and promoters, sponsors and event organisers.  This release and indemnity continues forever and binds your heirs, executors and personal representatives and assigns.

You consent to receiving any medical treatment including ambulance transportation that event organisers or gymnasium staff members think necessary and/or desirable when training for, competing in or after an event.


You understand that compulsory insurance cover (if any) taken out for participants in an event may not cover you for any or all injury, loss or damage sustained by you.

You understand and acknowledge that safety precautions undertaken by event organisers (such as equipment checks) are a service to you and other competitors but are not a guarantee of safety.

You agree that you are fully responsible for the security of your personal belongings at all times at or in connection with an event.

Event organisers may change the event format at their discretion.  If that occurs, this Agreement applies to the changed format.

You acknowledge and consent to photographic and electronic images being taken of you before, during or after an event by an official representative of RRR.com or the event organiser.  You acknowledge and agree that such photographs and electronic images are owned by RRR.com or the event organiser and that RRR.com, the event organiser and event sponsors may use the images, your name and your performance for promotional or other purposes at any time, by any form of media without your further consent being necessary.  RRR.com and the event organiser are not responsible for photographs and electronic images taken by persons who are not an official representative of RRR.com or the event organiser.

You agree to abide by all event rules and directions given by RRR.com or the event organiser.

Prohibited Non Commercial Use by Members
The RRR.com website is for the personal use of individual members only. Businesses, groups, organizations and companies are prohibited from registering as members but are allowed to register as Merchants. Registration as a Merchant involves agreeing to a different set of terms and conditions which can be provided to a Merchant or prospective Merchant upon request and solely at the discretion of RRR.com having regard to the nature of the proposed relationship between RRR.com and the Merchant or proposed Merchant. 

The RRR.com website may not be used by you for commercial endeavors, collecting RRR.com names and/or email addresses, or sending unsolicited emails. Unauthorized framing / linking to the RRR.com website is deemed to be a breach of the express intellectual and commercial property of RRR.com and is expressly prohibited. Any breach of this rule will be investigated, and appropriate legal action will be taken which may include a claim against you for damages and/or an injunction.



Range of Service 
You may become a member of the Service at no cost. As a member RRR.com gives you the ability to participate in all features and services available within the Service and other charged services as they become available. Membership of RRR.com gives you the ability to create one member profile only. Multiple profiles are not allowed however you may create and / or participate in multiple groups of shared interest. You may also participate in various events and promotions offered from time to time by RRR.com and any of our partner merchants from time to time. You may also communicate with various Merchants or other members via the RRR.com communications centre. You may also list items, goods or services (of such classes as RRR.com determines in its absolute discretion) in the RRR.com classifieds pages as and when they become available. If you chose to list goods on the RRR.com classified pages you expressly acknowledge the separate terms and conditions relating to our classifieds pages.

The RRR.com website may contain information about the products and services of third parties ( 'Merchants ').  You acknowledge and agree that insofar as goods and services (or information about goods or services) are offered on or through the RRR.com website by Merchants:

(a)	the information published on this website about the goods or services of the Merchants is provided by the Merchants.  RRR.com is not responsible for the information published by Merchants;

(b)	RRR.com does not act as agent or broker of the Merchants;

(c)	RRR.com does not act as your agent or broker in relation to the goods or services provided by the Merchants;

(d)	any agreement entered into with a Merchant as a result of your use of this website is an agreement between the Merchant and you;

(e)	RRR.com does not provide advice to you in relation to the goods and services offered by the Merchants; and

(f)	RRR.com does not provide any warranties in relation to the goods or services provided by the Merchants and will not be liable to you or any third party for any failure, wrong or default of a Merchant.

Purchase of v-Tokens 
In order to participate in the Services you may be required to purchase v-Tokens in certain circumstances. V-Tokens are non-refundable pre-paid rights that allow you to participate in a greater range of Services within the RRR.com website. Please see the  'v-Tokens ' page for further details and the current v-Token prices and expiry dates. The v-Token price list forms part of this Agreement. RRR.com reserves the right to change the v-Token prices at any time and to charge different v-Token amounts having regard to the nature of the specific Service to which that v-Token charge applies. If you are unhappy with any v-Token changes you may terminate your membership by selecting 'terminate account' within your account settings, writing to our address listed below or by sending us an email at support@runriderun.com. 

Declaration of Trust 
RRR.com is committed to supporting selected charities.  Where RRR.com specifies that a percentage or amount from a payment by you is to be given as a charitable donation to a particular charity:

(a)	that amount will be shown separately on the vendor generated tax invoice; and

(b)	RRR.com declares that it will hold such amount upon trust for the specified charity absolutely until such amount is paid to the particular charity.

Duration, Expiry and Termination 
This Agreement commences on your completion of this online registration and will remain in full force and effect while you are a member of the Service. You may terminate your membership at any time, for any reason, effective upon receipt by us of your written or email notice of termination. You may terminate your account online by selecting 'terminate account' within your account settings, contact us at our address listed below or you may email us at support@runriderun.com. 

We may immediately terminate your membership and your access to the Service at any time because you have breached this Agreement or acted in a way that we believe is likely to be detrimental to RRR.com and we will send you notice of termination at the email address you provide in your application for membership or such other email address as you may later provide to us. 

If we terminate your membership of the Service because we are of the opinion that you have breached the Agreement or acted in a way that we believe is likely to be detrimental to RRR.com, we will not refund any payments made. We can terminate this Agreement at any time by giving you reasonable advance written notice. In the case of violation of one or more of the terms of this Agreement by you, we may block your account(s), delete prohibited content, prevent publication of all or part of your member profile, remove you from any groups that you participate in and terminate any groups that you may have created.

We may do this at any time at our sole discretion, and we are not obliged to provide you with any reasons if we exercise our discretion in this regard in whole or in part. We may also block your access to all or part of the Service, either permanently or temporarily. In addition, RRR.com may at its sole discretion deactivate the accounts of members who have not used the Service for a period of 6 months or more (as calculated by the date of last connection to the Service).

Posted Content and Prohibited Content 
Any material that you transmit or post to the RRR.com website will be considered non-confidential and non-proprietary and will form part of the intellectual property of RRR.com. We will have no obligations with respect to such material. We will be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes at our sole discretion and having regard to our obligations to you as disclosed in our Privacy Policy. In that regard, this clause excludes your personal information which will only be used in accordance with our Privacy Policy.

RRR.com may review and delete any content, emails, Instant Messenger conversations, photos or profiles (collectively, 'Content') that we judge to violate this Agreement or judge as offensive, illegal, or that might harm, endanger, or violate the rights of members. 

You are solely responsible for the Content that you post on RRR.com or Content you transmit to other members using our Service. You agree that the Content is accurate, not in breach of this Agreement, and not harmful to any person in any way. 

The information that you supply to RRR.com and post on the RRR.com website must be accurate and conform to reality. You shall not include in your member profile or photos, any telephone numbers, street addresses, last names, URLs or email addresses that may identify you personally. 

You shall not advertise to, or solicit, other members to buy, sell or hire any products or services through our Service other than through our classified pages or by you becoming an accredited RRR.com merchant. If you wish to engage in any of the activities referred to in this paragraph you are obliged to apply to become a Merchant of RRR.com. You may not transmit any chain letters or junk email to other members. 

You shall not create multiple profiles. 

The following is a partial and non exhaustive list of the kind of Content  which is prohibited on the RRR.com website. RRR.com reserves the right to amend, add to or delete from this list at any time at the sole discretion of RRR.com. 

It includes Content that is or in RRR.com s opinion:
1.	is offensive; 
2.	promotes racism, bigotry, hatred, harassment, or physical harm of any kind against any group or individual;
3.	constitutes a profile or photographs of any third person used without their permission;
4.	profile photos containing any person other than yourself; 
5.	contains a cartoon or illustration;
6.	contains images of animals, scenery or objects of anything other than your current self (this clause does not apply to Gallery or inventory photos); 
7.	is sexually explicit or contains sexual references / innuendo;
8.	involves the transmission of unsolicited mass mailing;
9.	promotes information that is false, misleading or deceptive or capable of being misleading or deceptive;
10.	promotes, or provides information about, illegal activities or conduct;
11.	is abusive, threatening, obscene, offensive, defamatory or libelous;
12.	is an unauthorised copy of another person's copyright work or otherwise breaches any person s intellectual property rights;
13.	contains restricted or password only access pages, or hidden pages or images;
14.	contains pictures of people under the age of 18 (even if they are your children);
15.	provides material that exploits people under the age of 18, or is used to solicit information from anyone under 18;
16.	solicits passwords or personal identifying information from other users;
17.	engages in commercial activities and/or sales without our prior written consent; or
18.	is otherwise unlawful.

IMPORTANT: RRR.com reserves the right to investigate and take appropriate legal action against anyone who violates this clause. We may suspend or terminate any member or hide the Profile if it is judged offensive or if it includes identifying information.

Prohibited Activities
RRR.com reserves the right solely at our discretion to investigate and terminate your membership if you have misused the Service, or behave in a way which we regard as inappropriate, unlawful or illegal. The following is a partial list of the type of actions that you may not engage in with respect to the Service. RRR.com reserves the right to amend this list at any time. It includes: 

1.	You will not send or post material which constitutes or encourages conduct that would be considered a criminal offence in Australia or any other country in the world.
2.	 You will not send or post material which is prohibited by this Agreement or otherwise infringes the rights of any third party. 
3.	 You will not post, distribute or reproduce in any way any copyright material, trademarks, or other intellectual property or proprietary information without obtaining the prior consent of the owner of such proprietary rights.
4.	You will not impersonate any person or entity.
5.	 You will not harass any other person.
6.	You will not solicit money from any other person.
7.	 You will not express or imply that any statements you make are endorsed by RRR.com without our specific prior written consent.
8.	You will not use any robot, spider, or other device or process to retrieve, index, or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
9.	You will not "frame" or "mirror" any part of the Service or the RRR.com website, without RRR.com 's prior written authorization.
10.	You shall not use code or other devices containing any reference to RRR.com, our Service or website to direct persons to any other web page.
11.	You will not modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service or the RRR.com website or any software used on or for the Service or cause others to do so.
12.	You will not use the Service in connection with any chain letters, spamming, junk email or any unsolicited messages.
13.	You will not upload files that contain viruses, corrupted files or other similar software or programs that may damage the operation of the RRR.com website or any other person s computer or property.
14.	You will not restrict or inhibit the use of the Services or the RRR.com website by others.

RRR.com Account Security and Access 
You are responsible for maintaining the confidentiality of your RRR.com User Name and password ( UNPW ), and you are fully responsible for all activities that occur under your RRR.com UNPW. You agree to immediately notify RRR.com of any unauthorised use of your RRR.com UNPW or any other breach of security and to ensure that you exit from your account at the end of each internet browser session. RRR.com will not be liable for any loss or damage arising from your failure to comply with this provision. You should use particular caution when accessing your account from a public or shared computer or any computer that you believe or may have reason to believe is not secure so that others are not able to view or record your password or other personal information. 

While RRR.com endeavours to ensure that the RRR.com website is normally available 24 hours a day, we do not guarantee that it will be uninterrupted or error free. Access to the RRR.com website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control. RRR.com at any time may request some form of identification to establish the creditability of an account or its contents.

Intellectual Property
RRR.com owns and retains all intellectual property and commercial proprietary rights in the RRR.com website and the Service and any Content posted on the RRR.com website. RRR.com 's materials may not be reproduced, copied, edited, published, transmitted or uploaded in any way without RRR.com 's express written permission. You may not post, distribute, or reproduce in any way any copyright material, trademarks, or other intellectual property or proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on the Service in a way that constitutes copyright infringement, please contact us at support@runriderun.com or our address listed above.

Privacy
Use of the RRR.com website and/or the Service is governed by our Privacy Policy as set out on this RRR.com website and such Privacy Policy forms part of these terms and conditions. 

Disclaimers
The material at the RRR.com website is provided 'as is' without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, RRR.com provides you with this RRR.com website on the basis that RRR.com excludes all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill except where such law prohibits their exclusion, in which case they are included and RRR.com limits its liability therefrom, at its option, to the replacement, resupply, repair or payment for such replacement, resupply or repair of such goods or services) which, but for this legal notice, might have effect in relation to the RRR.com website.  We do not represent or endorse the accuracy or reliability of any advice, opinion, statement or other information displayed, uploaded or distributed through the Service by us, our partners or any member or any other person or entity. You acknowledge that any reliance upon such opinion, member profile, advice, statement or information is solely at your own risk and with no recourse or other right of action in law or in equity against RRR.com or its servants or agents. We are not responsible for the conduct, whether online or offline, of our members. Please use caution and common sense when using the RRR.com website and the Service. 

Limitation on Liability
Subject to any liabilities that may not be limited by law, RRR.com, and any related person, company or entity, will not be liable or responsible to you or any third person for any amount or kind of loss or damage that may result (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption of any type, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the Service, this RRR.com website or any RRR.com events developed, staged, managed or outsourced by RRR.com in any way or in connection with the use, inability to use or the results of use of this RRR.com website. Subject to the foregoing, RRR.com's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to RRR.com for the Service during the term of your membership. 

Customer Support
RRR.com may from time to time provide assistance and guidance through its customer support representatives. If we feel that your behaviour towards any of our customer support representatives or other employees is at any time threatening or offensive, we reserve the right to immediately terminate your membership and you will not be entitled to any refund.

Applicable Law
These terms and conditions and this Agreement are governed by the law in the State of Victoria Australia and you agree to the exclusive jurisdiction of the courts in Victoria (and courts of appeal therefrom).

General
We may alter or amend these terms and conditions at any time and will use best endeavours to provide notice of any change. You may terminate your membership at any time but will be deemed to have accepted any alteration and/or amendment if you continue to use the Service after notice. In the event that you have any claim or action against any other member arising from that member's use of our RRR.com website or the Service, you agree to pursue such claim or action independently of and without any demands from RRR.com, and you release RRR.com and its servants and agents from all claims, liability and damages, arising from or in any way connected to any claim or action. If a claim or action is brought against us from your activities or use of the RRR.com website or the Service, including any breach by you of this Agreement or any charges or complaints made by other parties against you, you agree to pay, hold harmless and defend us in the claim or action. You also agree to cooperate as fully as reasonably required in the defence of any claim and allow us to assume the exclusive defence and control of the matter. If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Agreement shall continue in effect.
